These Terms of Service (hereinafter referred to as the “Terms”) define the terms and conditions governing your use of the QR Feast website, cloud-based SaaS platform, mobile applications, and Kitchen Display System (KDS) (collectively referred to as the “Service,” the “System,” or the “Software”). By using this website or any part of the Service, you agree to be fully bound by these Terms.
Acceptance of Terms
By accessing or using our website, platform, mobile applications, or any related services, you agree to comply with these Terms and all applicable laws and regulations. If you do not agree to any part of these Terms, you must not use the Service.
Definitions
- “Service”: Includes all features provided through the QR Feast platform, including point-of-sale systems, menu management, electronic menus, reservations, reporting, mobile employee applications, KDS, printing services, and related tools.
- “User”: Any individual or legal entity that accesses or uses the Service.
- “Subscriber”: A User who has an active subscription and authorized login credentials.
Subscription and Account
- You may be required to create an account to access certain features of the Service.
- The User is solely responsible for maintaining the confidentiality of account credentials and all activities conducted through the account.
- Providing false, misleading, or impersonated information during registration is strictly prohibited.
- Accounts may not be shared, resold, transferred, or sublicensed to third parties.
Permitted and Prohibited Use
- The Service must be used in compliance with all applicable local and international laws and regulations.
- Users are prohibited from using the Service to sell, promote, or manage alcoholic beverages or any illegal, unauthorized, or restricted products or services.
- Users must not misuse the Service, attempt to breach its security, disrupt its operation, or harm other users.
Mobile Applications and KDS Usage
- The use of employee mobile applications and KDS is the responsibility of the Subscriber.
- The Subscriber is responsible for assigning appropriate permissions and roles to staff members.
- QR Feast is not responsible for operational errors, staff misuse, or incorrect order handling resulting from human actions.
Data and Intellectual Property
- All software, content, trademarks, logos, designs, and materials provided through the Service are the exclusive property of QR Feast or its licensors.
- No part of the Service may be copied, modified, distributed, reverse engineered, or reproduced without prior written consent.
- All data entered by the User remains the property of the User; however, all system architecture, technical implementation, and operational rights remain exclusively with QR Feast.
User Obligations
- The User is responsible for ensuring compliance with all applicable laws when using the Service.
- The User bears full responsibility for all content, data, and information entered into the system, and QR Feast shall not be liable for any unlawful or improper content.
Payments and Refunds
- Certain features and services are available only through paid subscription plans as published on the website.
- All subscription fees are billed in advance.
- All payments are non-refundable once processed, unless otherwise stated explicitly.
Subscription Termination
- Upon expiration or cancellation of a subscription, access to the Service may be suspended or terminated immediately.
- QR Feast may retain User data for a limited period for legal, regulatory, or operational purposes, in accordance with the Privacy Policy.
Limitation of Liability
- The Service is provided on an “as is” and “as available” basis without warranties of any kind.
- QR Feast does not guarantee uninterrupted or error-free operation of the Service.
- QR Feast shall not be liable for any indirect, incidental, consequential, or financial losses arising from the use or inability to use the Service.
Modifications to the Terms
QR Feast reserves the right to update or modify these Terms at any time. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts within the Kingdom.
